Mediation: If the dispute is not resolved within thirty (30) days, the parties may participate in non‑binding mediation conducted in the United States.
Arbitration: Failing mediation, the dispute shall be finally resolved by binding arbitration under the rules of the American Arbitration Association in the United States. The arbitration will take place in a location mutually agreed upon by the parties, or if no agreement can be reached, in a court located in the state of New York.

These provisions shall not preclude the parties from seeking injunctive relief or other equitable remedies in a court of competent jurisdiction. The prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

7. Governing Law

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. The parties submit to the exclusive jurisdiction of the federal and state courts located in the United States for the resolution of any such disputes.

8. Miscellaneous

These Terms constitute the entire agreement between you and Quickdishmagic regarding your use of the Site and supersede all prior or contemporaneous understandings, whether written or oral. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Quickdishmagic reserves the right to suspend or terminate your access to the Site at any time for any reason, including but not limited to violation of these Terms or any applicable law. We may also modify the Site’s features, content, or policies at any time without notice.
